How the day count decides residency
Most income-tax states can tax you as a statutory resident if you keep a permanent place of abode there and spend more than 183 days in the year (184+). Two groups are different:
- No-income-tax states — Alaska, Florida, Nevada, New Hampshire, South Dakota, Tennessee, Texas, Washington, and Wyoming — have no residency day count that makes you taxable on income.
- A few states use a facts-and-circumstances test with no bright-line day count, so no single number decides residency.
For a mover, the harder job is usually proving you stayed under the old state's line — which is exactly what a contemporaneous day record is for.
